Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "Client") and RecoupFi ("we," "us," or "our") governing your use of our unclaimed property recovery service and website (collectively, the "Service"). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Service Description
RecoupFi is a contingency-based unclaimed property recovery service. We search state unclaimed property databases on your behalf, identify assets that may belong to you, prepare and file the necessary claims with the appropriate state agencies, and facilitate the recovery of those funds to you. Our Service is designed to simplify the claims process and maximize your recovery with no upfront cost.
2. Eligibility
To use the Service, you must be at least 18 years of age and possess the legal capacity to enter into a binding agreement. You must be the rightful owner of the unclaimed property you are claiming, or an authorized legal representative (such as an executor, administrator, or holder of a valid power of attorney) acting on behalf of the rightful owner. By initiating a claim, you represent and warrant that you meet these eligibility requirements.
3. Fees
RecoupFi operates on a contingency fee model. You pay nothing upfront. Our fee is a percentage of the amount successfully recovered on your behalf, subject to the caps imposed by applicable state law. The typical fee range is 10–25% of the recovered amount, depending on the state in which the property is held. For reference:
- California: Fee capped at 10% of the recovered amount.
- New York: Fee capped at 15% of the recovered amount.
- Florida: Fee capped at 20% of the recovered amount.
Fees are collected only upon successful recovery of funds. The specific fee applicable to your claim will be disclosed before you authorize the claim. By initiating a claim through our Service, you agree to pay the applicable contingency fee upon successful recovery.
4. Your Responsibilities
In order for us to effectively process your claims, you agree to:
- Provide accurate, complete, and truthful personal information as required for claim filing.
- Respond promptly to requests for supporting documentation, identity verification, or other materials needed to advance your claim.
- Refrain from filing duplicate claims for the same property through other recovery services or directly with the state while your claim is active with RecoupFi.
5. No Guarantee of Recovery
While we work diligently to recover unclaimed property on your behalf, we cannot and do not guarantee that any particular claim will be approved or that any specific amount will be recovered. State unclaimed property offices retain sole discretion over the approval or denial of claims. If a claim is denied by the state agency, you owe RecoupFi nothing.
6. Intellectual Property
The RecoupFi name, logo, trademarks, website design, text, graphics, and all other content and materials available through the Service are the exclusive property of RecoupFi or its licensors and are protected by applicable intellectual property laws. You may not reproduce, copy, distribute, modify, or create derivative works from any part of the Service without our prior written permission.
7. Limitation of Liability
To the maximum extent permitted by applicable law, RecoupFi's total aggregate liability to you for any and all claims arising out of or relating to the Service shall not exceed the total fees actually collected by RecoupFi for your claim. In no event shall RecoupFi be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, regardless of the cause of action or theory of liability, even if RecoupFi has been advised of the possibility of such damages.
8. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association ("AAA"). The arbitration shall be conducted in the State of Delaware. Judgment on the arbitration award may be entered in any court of competent jurisdiction. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
9. Termination
Either party may terminate the service relationship at any time. If you wish to cancel a claim that is currently in progress, you may do so by contacting us at hello@recoupfi.com. No fees are owed for cancelled claims unless funds have already been successfully recovered prior to your cancellation request. RecoupFi reserves the right to terminate or suspend your access to the Service at any time, with or without cause, upon reasonable notice.
10. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
